After a DUI, your license will automatically be suspended beginning 30 days after the arrest. However, you or your lawyer can contest the license suspension by requesting an administrative hearing. Our attorney will represent you at the DMV hearing and argue that your license suspension be thrown out.

If you are facing criminal charges for drunk driving, it is extremely important for you or your attorney to request an administrative license suspension hearing from the Department of Motor Vehicle's Driver Safety Department within 10 calendar days of your arrest. If the hearing is not requested, your license will be automatically suspended and you will lose the right to challenge the license suspension.

DUI Penalities Impacting Your Driver's License

While requesting a DMV hearing will delay (or stay) the suspension of your driver's license, your license still may be suspended following the hearing.  If you lose your DMV hearing, you may face the following administrative penalties on your driver's license*:

  • First offense DUI: 6 months license suspension
  • Second offense DUI: 2 year license suspension
  • Third offense DUI: 3 year license revocation
  • Fourth offense DUI (or subsequent offense): 4 year license revocation

*These penalties apply to individuals facing drunk driving charges for driving with a BAC of .08 or higher. There are more severe license penalties for breath test refusal and extreme BAC levels.
