One woman in California was recently arrested on charges of drinking and driving and causing injury. The DUI arrest was made on a Monday following a vehicle collision. The charges she faces in connection with this accident are nearly identical to accusations she faces in a separate accident that took place in the spring of 2015.
In the recent accident, the woman was driving a sport utility vehicle and reportedly crashed into another sport utility vehicle that was making a turn. The driver of the other vehicle suffered minor injuries. The woman and six kids in the her vehicle also suffered minor injuries. She has been arraigned on criminal charges of DUI that resulted in injury, which is a felony.
The woman was also arrested back in June 2015 for allegedly driving under the influence. It remained unclear whether a police officer stopped her or she was involved in a crash, but she, again, had kids with her. She ended up being charged with child endangerment in relation to a DUI.
If appropriate to the accused woman's circumstances, defense counsel for the woman might look at the possibility of plea bargaining with the prosecution. A plea deal might offer the advantage of resulting in a lighter sentence for the individual compared with what may result if she were to be found guilty of her DUI charges at trial. The woman has the right to go to trial, forcing prosecutors to prove the accusations by presenting evidence that meets the criminal justice system's exacting requirements in California.
