A person who was reportedly driving under the influence caused a fatal accident in California recently. The alleged DUI accident occurred early in the morning on Thursday. The individual who died in the crash was a 5-year-old boy.
At around 12:16 a.m., a woman, 24, was going north on an avenue and suddenly swerved and collided with an apartment. The 5-year-old boy who ended up dying was inside the apartment with four family members at the time of the crash. The family members were also injured in the collision.
The driver's condition was considered fair following the crash. The woman reportedly told police that she had swerved after another automobile had cut her off. However, investigators said they later learned that she had been driving under the influence when the motor vehicle accident happened.
The woman thought to have been driving under the influence may decide to go to trial to fight any charges filed against her. As an alternative, she may seek to negotiate a plea agreement with prosecutors, which may offer the advantage of leading to lighter charges and thus a more personally favorable sentence than what may result if she were to be found guilty at trial. The criminal defense in either situation will strive for an outcome that is in the best interests of the accused considering the circumstances surrounding the DUI case. Defense counsel will also ensure that none of the client's applicable rights are violated during any stage of the criminal proceedings in the state of California.
