A man in California was recently arrested for driving while under the influence. The DUI arrest took place on a Thursday morning. The man charged with drunk driving is 21 years old.
According to authorities, they responded to the single-car crash at around 1:30 a.m. While at the crash scene, they found an automobile that had struck the center median of the road. The car was disabled as a result of the collision.
Police determined that the man driving the car had been driving while under the influence. He was therefore taken into custody. His passenger suffered injuries as a result of the collision.
Although the man who was arrested following the accident has been charged with DUI, he is presumed innocent until and unless proved guilty by prosecutors beyond a reasonable doubt. DUI charges are serious because they can tarnish a defendant's reputation, making it harder to rent cars or claim jobs in the future in California, for example. However, the criminal defense will scrutinize the evidence that the prosecution plans to present in court to support their allegations; for instance, perhaps the field sobriety test results are not accurate because the test was not administered correctly, or maybe external factors might have impacted their results. Depending on the weight of the prosecution's evidence, the criminal defense may decide to pursue a plea agreement with prosecutors, which may lead to a lesser charge and thus a more lenient sentence than what would be rendered following a guilty finding at trial.
