2 face gun and drug charges in California

Two individuals in California have been accused of committing both weapons and drug crimes. Their arrests on gun and drug charges took place on a recent Saturday night. Their arrests occurred after a police officer spotted a recreational vehicle he reportedly recognized from prior criminal activity.

The police officer said he found the two individuals in the recreational vehicle. Police also allegedly saw drug paraphernalia inside the automobile. They proceeded to search the motor vehicle.

During the search, they claim to have uncovered evidence of the sale of methamphetamine. Police said they also found two loaded guns. The two individuals, both convicted felons, were arrested for possessing guns while being felons and also for possessing a drug for sale.

Anybody facing drug charges in California is always presumed innocent until and unless proved guilty in court and by evidence that is found to be beyond a reasonable doubt. At trial, the prosecution must prove every element of the charges -- a burden that is typically difficult to meet. This standard exists so as to prevent innocent people from being convicted.

Rather than going to trial, however, an individual facing drug charges may choose to try to negotiate a plea deal with the prosecution instead. This may offer the benefit of leading to a lighter charge and thus a more lenient sentence than what the defendant would receive following a finding of guilt at trial. An attorney in California will push for the most favorable outcome for the client in either scenario and will ensure that his or her rights are not violated during the criminal proceedings.
