California man faces drunk driving charges

A man who has been accused of causing the death of one of his sons is facing serious charges, according to local sources. The California man was arrested on suspicion of drunk driving following a car accident on Feb. 25 that resulted in the death of one of his sons and the serious injury of a second. If he is found guilty, he could face years in prison. 

San Benito authorities say they arrested the 30-year-old man following an accident that saw his vehicle drift off the road and crash into a utility pole. His 6-year-old son was pronounced dead at the scene of the crash while his 7-year-old son was rushed by air to a local hospital in serious condition. Police on the scene say they believed the man was drunk and arrested him. It is unclear whether any roadside tests were conducted on the scene. 

The man had been charged with DUI in the past, which prosecutors say led credence to the current charges. He now faces charges of murder, child endangerment, vehicular manslaughter and driving with a suspended license, as well as the aforementioned prior DUI charges that influence the severity of his current charges. He is currently being held against $1 million in bail and is scheduled to appear in court on April 10. 

The loss of a child is a crushing tragedy for any parent. California prosecutors will have to provide compelling evidence that the man knowingly got behind the wheel while intoxicated if the drunk driving charges are to result in a conviction. The man's criminal defense team will work to determine whether the conduct of the officers on the scene at the time was in accordance with the man's rights.
